When the matter was listed on 11.08.2016, there was no representation for the appellant. Hence, this Court directed the Registry to list the matter under the caption "for dismissal" on 12.08.2016. But, on 12.08.2016, the Registry, instead of listing the matter under the caption "for dismissal", listed the same under the caption "Final hearing". Therefore, this Court directed the Registry to list the matter under the caption "for dismissal".

2. Today, even though the matter is listed under the caption "for dismissal", when the matter is called, there is no representation for the appellant.

3. Learned counsel for the respondent represents the matter.

4. Hence, the appeal is dismissed for non-prosecution.

5. As a sequel thereto, Miscellaneous Applications, if any, pending in this appeal shall also stand dismissed.
