THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 841 of 2015 ORDER: (Per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed by the petitioner being the owner of the vehicle in question.
Learned Government Pleader appearing for the respondents does not want to file any counter.
The grievance of the petitioner is that his vehicle has been seized without any authority of law. He says that he has also submitted necessary records.
However, after hearing both the learned counsel and considering the record, we notice that the petitioner's vehicle has been seized because of non-payment of tax and also non-obtaining of the fitness certificate.
Under these circumstances, we direct the respondent authorities to release the vehicle in question the moment petitioner pays the tax due and payable. After getting the vehicle released, the petitioner shall take steps immediately to obtain fitness certificate from the authority concerned, as we notice that the same is not found, and submit a xerox copy of the same to the seizing authority forthwith thereafter. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
