The petitioner was appointed as a Sanitary Worker in respondent No.4 office and joined on 16.08.1974. He was mentally disturbed in the year 2004 and left home. He was wondering here and there and his family searched for him for six years and they found him in a small village in Guntur District in the month of January 2010. Thereafter, he was brought to his native village Gammalapalem in Nellore District. He was taken to Manasa Psychological Clinic for treatment and after taking medicines he was found fit for duty. Thereafter, he approached respondent No.3 and submitted a representation requesting permission to discharge his duties as Sanitary Worker. Then he came to know that the respondent No.3 issued proceedings on 17.12.2009 taking into consideration the unauthorized absence of petitioner from 16.07.
2004 and holding that he was deemed to have resigned from T.T.D. service. Against the said proceedings, he preferred an appeal to respondent No.2 as contemplated under Section 120(1) of the A.P. Chatirable and Hindu Religious Institutions and Endowments Act, 1987 and the said appeal is numbered as Appeal No.93 of 2013. When the same was not disposed of for the last three years, the present writ petition was filed. Learned Standing Counsel appearing for respondent No.2, after instructions, submits that the appeal is still pending before the respondent No.2.
In the circumstances, this Writ Petition is disposed of
directing the respondent No.2 to consider the appeal, preferred by the petitioner, in Appeal No.93 of 2013 in accordance with law and dispose of the same within three (3) months from the date of receipt of a copy of this order.
