THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.10389 of 2025 ORAL ORDER:
Seeking the Court to enlarge the petitioner who is arrayed as accused in Crime No.510 of 2025 of Attapur Police Station, Cyberabad Commissionerate, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 16.06.2025 the complainant/victim lodged a complaint before the Police stating that she married Ravinder in the year 2011 and had two children, but her husband later passed away. While working as a nurse at Germanten Hospital, Attapur, she searched for a dance school and came to know about Satya Dance Studio at Maruthi Nagar, Attapur, where she took admission. After a few days, she became acquainted with the accused, Satyanarayana (25 years), a dance master at the studio. They started communicating through phone calls and messages, during which the accused proposed to marry her. Believing his promise, she accepted and, on his insistence, met him physically several times at the studio. However,
when she later asked him about marriage, he refused and stated that he would not marry her.

Heard Sri K. Rajshekar, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated in the alleged offence under Section 69 B.N.S.S. and had not committed any offence and that the complaint and remand report did not disclose any specific incident establishing his involvement, and the allegations were made only to harass him. Even as per the complainant's version, there was no inducement or suppression of identity to obtain her consent for marriage, and the delay in raising allegations of sexual intercourse from 2023 clearly showed the complainant's ill-intention. He further submitted that the police mechanically registered the FIR without proper investigation or verifying the applicability of law, and continuation of proceedings amounted to an abuse of process. The petitioner had been in judicial custody since
26.06.2025, most witnesses had already been examined, and there was no possibility of tampering with evidence. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations against the petitioner are heinous in nature. Further, the investigation was not yet completed. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that the petitioner has been in jail since 26.06.2025. As seen from the record, as of today, no charge sheet has been filed. 14 witnesses have been examined, and the material part of the investigation has been completed. Considering the facts and circumstances of the case, as well as the period of incarceration of the petitioner, this Court
deems it fit to grant bail to the petitioner, subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned XIII Additional District and Sessions Judge, Cyberabad, Ranga Reddy District at L.B.Nagar.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
