THE HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.384 of 2008 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed seeking to issue a Writ of Mandamus declaring the action of respondents in interfering with the peaceful possession and enjoyment of the petitioners in an extent of Ac.4.40 cents in Sy.No.55/2, Ac.0.90 cents in Sy.No.77P, Ac.1.10 cents in Sy.No.80P, Ac.0.35 cents in Sy.No.55/3 and Ac.0.60 cents in Sy.No.76P, totalling Ac.7.35 cents of Mangalam Revenue Village, Tirupathi Urban Mandal, erstwhile Chittoor Taluq, Chittoor District and for consequential direction not to dispossess them from the lands above mentioned. Learned counsel for the petitioners submits that despite the order of status- quo passed by this Court in W.P. No.27652 of 2005, the respondents are interfering with the peaceful possession and enjoyment of the property.

In the counter affidavit filed by the respondents, it is categorically asserted that the petitioners are not in possession of the subject land, the subject property is in possession of the Government. It is further asserted that the status quo granted by this Court in W.P. No.27652 of 2005 as well as in this writ petition is still in existence. W.P. No.

three months and it is further directed that till the orders are passed in the review, the status-quo shall be maintained. Thus, in view of the Orders passed in W.P. No.27652 of 2005, no further orders are required in this writ petition. Accordingly, the writ petition is disposed of. No costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
