HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 2177 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the Clause-B of Medical Reimbursement of Hospital expenses to retired employees on superannuation and full time Directors on demitting office insofar as it denies the benefits to those who have taken voluntary retirement under ABEVRS-2000, as illegal and arbitrary.

Heard Sri C.V.Mohan Reddy, learned counsel for the petitioner and Sri K. Lakshmi Narasimha, learned standing counsel for the respondent bank.

It has been contended by the petitioner association that the respondent bank is not extending the benefit of Medical Reimbursement of Hospital expenses to the retired employees who have retired under voluntary retirement scheme. It is further contended that the persons who have retired under voluntary retirement scheme should also be treated as persons who have retired on attaining the age of superannuation and they cannot be discriminated further on the ground of retirement under voluntary retirement scheme. Therefore, he sought that appropriate orders may be passed to the respondents to extend the benefit of medical reimbursement of hospital expenses to the retired employees who have obtained retirement under voluntary retirement scheme. Having considered the submissions made by the learned counsel on either side and perused the record, this Court is of the

considered view that the writ petition can be disposed of directing the petitioner association to submit a representation afresh to the respondent bank within two weeks from the date of receipt of a copy of this order and upon receiving such representation, the respondent bank shall consider and pass appropriate orders thereon in addition to the earlier representation submitted by the petitioner, in four weeks thereafter, in accordance with the rules.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 23rd November, 2018 cbs
