THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 7324 OF 2013 ORDER:

This writ petition is filed to declare the inaction of the official respondents in taking appropriate action on the representations made by the petitioner association.

On 12.03.2013, interim direction was passed by this Court directing the 4th respondent/Commissioner, GVMC to consider the representation of the petitioner dated 19.01.2013 and pass appropriate orders after due notice to the 5th respondent. Heard learned counsel for the petitioner and the 5th respondent.

Learned counsel for the 5th respondent submitted that pursuant to the interim direction dated 12.03.2013 notice has been given to the 5th respondent and orders have been passed by the Commissioner, GVMC on 06.04.2013 directing the 5th respondent not to use the premises for marriages and other functions except for the purpose for which the permission has been obtained by them vide proceedings B.A.No.11269/2004/ACP-II, dated 17.09.2004.

The Commissioner also directed the Zonal Commissioner and the Assistant City Planner of Zone II to see that the above premises is exclusively used as a prayer hall and mediation hall and if any deviation is noticed, they shall take immediate action as per the provisions of the HMC Act, 1955.

In view of the proceedings dated 06.04.2013 of the 4th respondent, no further orders are required in this writ petition. The writ petition is closed accordingly. No costs. Pending miscellaneous petitions, if any, shall stand dismissed.
