THE HONB'E SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.25468 OF 2017 ORDER:

The writ petition is filed questioning the action of the respondents in not considering the application of the petitioner's school made on 6.2.2017 by fulfilling all the requirements for renewal of recognition for the Academic years 2017-18 to 2026-27 as illegal and arbitrary. It is the case of the petitioner that the petitioner's school was initially established in the year 1907 by American Baptist Foreign Mission Society, USA. It was upgraded into High School in the year 1970 by virtue of G.O.Rt.No.1479 dated 29.07.1970 and admitted into Grantin-Aid in the year 1978; that it is fully aided school right from the year 1960 onwards and it was given permanent recognition upto 5th class.

For classes 6th to 10th applications were being made from time to time for renewal of recognition and recognition is being renewed once in every five years and the last recognition renewed was on 16.10.2012 by the proceedings of the 3rd respondent. It is further stated that as the recognition was coming to an end by May, 2017, the petitioner school had submitted an application for renewal of recognition on 6.2.2017 fulfilling all the requirements for a further period of ten years from the Academic year 2017 -18 to 2026-27, but the respondents authorities did not take any steps to consider the application of the petitioner's school so far. Hence, the present writ petition.

A perusal of the material discloses that the petitioner's school was established in the year 1907 and it is the contention of petitioner that her school was granted aid in the year 1978 and it is fit for renewal for further period of ten years.

Having regard to the facts and circumstances of the case and especially in view of the application of the petitioner's school is pending

with the respondent authorities for renewal, the writ petition is disposed of directing the respondent authorities to consider and dispose of the application dated 06.02.2017 of the petitioner's school for renewal within a period of fifteen days from the date of receipt of copy of the order. Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed. No order as to costs.
