THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM SUO MOTU CONTEMPT CASE No. 841 OF 2016 O R D E R:
Today, while passing orders in W.V.M.P.No. 2392 of 2016 in Writ Petition No. 8806 of 2016, this Court, dealt with the facts, in detail, which necessitated initiation of suo motu contempt proceedings against the 4th respondent. It has been observed that the very granting of the interim order dated 27.04.2016 is only on account of the conduct of the 4th respondent in not promptly responding to the notice of the Court by furnishing the information sought for and not filing the counter-affidavit specifically dealing with the allegations of the petitioners in the Writ Petition. Since a prima facie opinion has been taken that the petitioners have not come to this Court with clean hands, the interim order dated 27.04.2016 has been vacated and the petitioners therein were directed to pay costs of Rs.5,000/- to the 7th respondent.
In this view of the matter, it cannot be said that there is negligence on the part of the 4th respondent in bringing true facts before this Court. Hence, the 4th respondent contemnor is discharged from the contempt proceedings.
The Contempt Case is accordingly closed.
