THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1326 of 2013 ORDER:

This contempt case was instituted alleging willful disobedience to the common order dated 10.04.2013 passed by this Court in W.P.Nos.17126 and 30291 of 2012. The petitioner herein is the writ petitioner in W.P.No.17126 of 2012. By the afore-stated order, the Tahsildar, Lingapalem Mandal, West Godavari District, was directed to cause necessary enquiry into the matter after giving due opportunity to both parties and address a consequential communication to the Eastern Power Distribution Company Limited of Andhra Pradesh (APEPDCL) as to the status of the 'No Objection Certificate' issued earlier. While so, a fresh 'No Objection Certificate' was issued by the Tahsildar, Lingapalem Mandal, on 28.06.2013 purporting to be in compliance with the order passed by this Court. As there was no direction by this Court to issue a fresh 'No Objection Certificate', the contempt case was admitted on 09.09.2015 and the respondents are present before this Court today pursuant to the same.

The learned Government Pleader for Revenue placed before the Court a copy of the proceedings dated 01.09.2015 issued by the Tahsildar, Lingapalem Mandal, withdrawing the 'No Objection Certificate' dated 28.06.2013 duly recording the fact that there was no direction from this Court with regard to issuance of a 'No Objection Certificate' afresh.

In the light of these proceedings, the error committed by the Tahsildar, Lingapalem Mandal, stands corrected and no cause is made out for exercising contempt jurisdiction.
