Heard Mr.Challa Siva Sankar for petitioner and Assistant Government Pleader (Assignment) for respondents 1 to 4. No representation for 5th respondent The petitioner challenges proceedings Ref.No.DT2/ 5310/ 2013 dated 28.02.2015 of 3rd respondent refusing to stay the proceedings Ref.No.POT/ 58/ 2007 dated 17.12.2012 of 4th respondent. On 18.03.2015, this Court granted interim suspension of proceedings dated 17.12.2012. The interim order is subsisting as on date. The subject matter of writ petition is limited to continue the stay order, pending consideration and disposal of appeal by 3rd respondent. The counsel for petitioner submits that the appeal is transferred from 3rd respondent to 2nd respondent. He prays for expeditious disposal of appeal Ref.No.DT2/ 5310/ 2015. I am satisfied, after perusing the material on record and keeping in view the order dated 18.03.2015, the writ petition can be disposed of by this order:

i) Respondents 2 and 3 are directed to consider and dispose of the appeal pending in proceedings Ref.No.DT2/ 5310/ 2013 within three months from the date of receipt of a copy of this order; and ii) The interim order granted on 18.03.2015 is directed to be continued till the disposal of appeal pending in proceedings

Ref.No.DT2/ 5310/ 2013 or as re-numbered by 2nd respondent;

The writ petition is, accordingly, disposed of. There shall be no order as costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
