THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.23575 OF 2007 ORDER:

Complaining inaction in settling and paying the petitioners retiral benefits such as pension, gratuity, leave encashment, D.A. arrears, arrears of service increments etc., consequent on the retirement of the petitioner as Supervisor in the 3rd respondent organization, the present writ petition came to be filed.

Heard Sri K.Venkatesh, learned counsel, appearing for the petitioner and Sri Palle Sriharinath, learned counsel, appearing for the 2nd respondent.

When the matter is taken up, it is submitted by the learned counsel for the petitioner that except the General Provident Fund, the respondents have paid all other benefits to the petitioner. It is further submitted by the learned counsel for the petitioner that the petitioner herein will make a representation to the respondents for payment of the General Provident Fund and the same may be directed to be considered by the respondents. This Court finds the said request as reasonable.

Recording the said submission, writ petition stands disposed of, permitting the petitioner herein to submit a representation to the respondents for payment of General

AVSS,J W.P.No.23575 of 2007 Provident Fund, if any, due to the petitioner, within a period of one month from the date of receipt of a copy of this order and if any such representation is made, the same shall be considered and appropriate action be taken, in accordance with law, within a period of three months thereafter. 5.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
