THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9240 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime.No.117 of 2023 on the file of Chityal Police Station, Nalgonda District, registered for the offence under Section 337 of IPC and Section 20 (b) (ii) (c) and 8 (c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

A-1 in the present case was arrested by Chityal Police for being in possession of 104 kgs of ganja. According to the prosecution, A-1, this petitioner and two others were travelling in the car along with the contraband. However, the car lost control and overturned. A-1 became unconscious

and this petitioner and two others fled from the scene according to the Police.

The name of the petitioner and two others were identified in pursuance of the confession of A-1. This Court by order dated 08.09.2023 granted the relief of regular bail to A-1. Keeping in view that the implication of this petitioner is on the basis of confession of A-1, the relief of regular bail can be granted to this petitioner, subject to following conditions: i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for a like sum each to the satisfaction of Judicial First Class Magistrate, Nalgonda.

ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer on every Monday and Wednesday for a period of eight weeks at 10.00 AM or until the charge sheet is filed, whichever is earlier.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
