HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24279 of 2004 ORDER:

This writ petition is filed challenging the orders passed by the Labour Court in Interlocutory Application No.73 of 2004 in Miscellaneous Petition No.1 of 2003 and batch, dated 07.08.2004, wherein the Labour Court had rejected the claim made by the petitioners herein.

Heard learned counsel for the parties.

A perusal of the impugned order shows that the Labour Court has rightly declined to interfere in the matter on the ground that the Bank was wound up and the Official Liquidator has been appointed to liquidate the assets of the Bank. Therefore, this Court is not inclined to interfere in the matter.

The writ petition is accordingly dismissed. However, the petitioners are given liberty to approach the Official Liquidator claiming the reliefs, if they are so advised. No order as to costs.
