HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28226 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction on the part of the respondent authorities in considering the representations of the petitioner dated 25.07.2016 and 01.08.2016 as illegal and arbitrary.

2. Heard the learned counsel for the petitioner, the learned Government Pleader for Irrigation and Command Area representing the respondents 1 to 4 and the learned Government Pleader for Land Acquisition, representing the respondents 5 to 7 (Telangana).

3. It is the case of the petitioner that he is the owner of an extent of Ac.1.00 guntas in Survey No.158/2, situated at Gampalapally Village of Thandur Mandal of Adilabad District. The respondents herein are undertaking works under mission Kakatiya programme. While executing the works, the eighth respondent has increased the height of weir by one feet, due to which, the land of the petitioner was sub-merged. It is the further case of the petitioner that his land is not fit for cultivation in future also. It is the further case of the petitioner that he made a representation on 25.07.2016 to the third respondent with a request to pay compensation to his land.

He also submitted another representation dated 01.08.2016 to the second respondent. The fact remains that the respondents 2 and 3 have not considered and passed any orders on the representations of the petitioner.

4. At the time of arguments, the only relief sought by the

petitioner is to direct the respondents to dispose of his representations dated 25.07.2016 and 01.08.2016 as expeditiously as possible.

5. Learned Government Pleaders also consented for the same by stating that the third respondent is the competent person to dispose of the representation of the petitioner.

6. Having regard to the facts and circumstances of the case and also the submissions made by both the counsel, the third respondent is hereby directed to dispose of the representation of the petitioner dated 25.07.2016 in accordance with law, as expeditiously as possible, preferably, within six weeks from the date of receipt of copy of this order.

7. Accordingly, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
