HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.10295 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the action of respondents 2 and 3 in not allotting the essential commodities to the petitioner fair price shop No.2 situated at Avulanna Village, Beluguppa Mandal, Ananthapur District and trying to terminate the dealership without any reasons, as illegal and arbitrary and for a consequential direction to the respondents to allow the petitioner to continue as fair price shop dealer.

3. It is submitted by the learned counsel appearing for the petitioner that though the petitioner deposited demand draft for the month of April, 2015 with the authorities for release of the essential commodities, they have not been released to the fair price shop of the petitioner. Admittedly, the authorisation of the petitioner is subsisting. During the subsistence of the authorisation, the respondents are under the duty to supply the essential commodities to the fair price shop of the petitioner.

4. In the circumstances, the writ petition is disposed of directing the respondents to issue essential commodities to the fair price shop of the petitioner during the subsistence of the authorisation. Miscellaneous applications, if any, shall stand closed. No order as to costs. __________________
