M.Vijaya Karan v. Sri S.K.Joshi, I.A.S.
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY CONTEMPT CASE No.2007 of 2014 23.01.2015 Between:
M.Vijaya Karan
...Petitioner
And The Secretary, Municipal Administration and Urban Development Department, Hyderabad and another
...Respondents
Counsel for the petitioner: Sri E.Madan Mohan Rao Counsel for respondents: Government Pleader for Municipalities The Court made the following:
ORDER:
This Contempt Case is filed alleging willful disobedience of the order, dated 21.12.2009, in W.P.No.10805 of 2003. By the aforementioned order, this Court has directed respondent No.1 to give the petitioner or his counsel, if chosen by the petitioner, an opportunity of personal hearing and pass a fresh order by dealing with all the contentions raised on behalf of the petitioner within a period of four months from the date of receipt of a copy of the said order. By order, dated 24.01.2014, respondent No.1 has rejected the petitioner's claim. Sri E.Madan Mohan Rao, learned counsel for the petitioner, submitted that while rejecting the claim of the petitioner, respondent No.1 has not followed the observations made by this Court in its order, dated 21.12.2009, in W.P.No.10805 of 2003.
Though I prima facie find the manner by which respondent No.1 has passed the aforesaid order not only unconvincing but also unsatisfactory, I am of the opinion that by passing the aforesaid order as directed by this Court, respondent No.1 has complied with the order, dated 21.12.2009, in W.P.No.10805 of 2003, and that if the petitioner feels aggrieved by the said order, he is entitled to file a fresh writ petition in order to question the same.
The Contempt Case is accordingly dismissed with liberty in terms of the observations made hereinabove.
