HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1742 of 2015 ORDER:

Upon hearing both sides at the admission stage, the following order is passed:

2. Having regard to the fact that charge sheet is filed and the matter is at the stage of committal, it is not a fit case to quash the proceedings. However, the petitioner/A.7 is given liberty to file discharge application before the concerned trial Court and if he does so, the trial Court shall dispose of the said application on merits at the earliest. It is brought to the notice of this Court that the learned Judicial First Class Magistrate, Kavali issued NBW against petitioner/A.7. The petitioner/A.7 is directed to appear before the learned Judicial First Class Magistrate, Kavali on or before 31.03.2015 and on his appearance, the learned Magistrate shall recall the NBW issued against him.

3. Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
