THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9707 OF 2017 ORDER:

Heard the learned counsel for the petitioner/accused of Crime No.116 of 2017 of Nagayalanka Police Station, Krishna District, registered for the offences punishable under Sections 406 and 420 IPC, from the report of the 1st respondent dated 27.09.2017 and also heard the learned public prosecutor, representing the 2nd respondent - State, before ordering notice to the 2nd respondent and perused the grounds urged in the quash petition and the contents of the FIR. 2.

There is nothing to interdict the investigation, but for to say, the petitioner shall not be arrested pending investigation, however, this order will not prevent the police to secure the presence of the petitioner as and when required for purpose of investigation. All defenses of the petitioner are left open. 3.

Accordingly and with the above observation, this criminal petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
