This Criminal Petition under Sections 437 and 439 Cr.P.C. is filed by petitioner - Accused No.2 in Crime No. 496 of 2021 on the file of P.S. Panjagutta, Hyderabad registered for the offences punishable under Section 370A IPC. and Sections 3, 4, 5 of Prevention of Immoral Trafficking Act, 1956, seeking bail. 2.
The case of prosecution is that on 26.10.2021 at 23.30 hours, a complaint was received from Additional Inspector of Police at Panjagutta, wherein it is stated that on the information received from Inspector of Police, AHTU CCS, DD, Hyderabad that some organizers ie. Rajesh Naik and others were running brothel by procuring female sex workers at H.No. 6-3-604, Flat No. 101, Hil Top Colony, Erramanzil, Khairathabad, and collecting Rs. 2,000/- to Rs.4,000/- from each customer, they conducted decoy operation and found one Rajesh Naik (Accused No.1) there and on enquiries, it was revealed that they have been conducting brothel in the said premises.

Learned counsel for petitioner Sri Gampa Venkatesham submits that petitioner was arrested and remanded to judicial custody on 26.10.2021 and from the last 46 days, he has been languishing in jail. It is further submitted that petitioner is unconnected with the alleged offences and he has been implicated in this case. It is also stated that petitioner has no criminal antecedents, hence, his case may be considered for grant of bail.

On the other hand, learned Assistant Public Prosecutor does not dispute the fact that petitioner has no criminal antecedents. However, he submits that investigation is pending and so far, four witnesses were examined, hence, petitioner is not entitled for grant of bail, at this stage.

Taking into consideration the fact that petitioner is languishing in jail from the last 46 days, this Court deems it appropriate to grant bail to him, however, on certain conditions. 6.
The Criminal Petition is therefore, allowed. Petitioner - Accused No. 2 shall be enlarged on bail in connection with Crime No. 496 of 2021 on the file of P.S. Panjagutta on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of XIV Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. He shall appear before the Station House Officer, Panjagutta Police Station on every second and fourth Sunday between 10.00 a.m. and 01.00 p.m. till the charge sheet is filed. ___________________________ LALITHA KANNEGANTI, J 13th December 2021 ksld
