HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.3352 OF 2016 ORDER:

The Criminal Revision Case is filed against the order dated 19.10.2016 passed in Crl.M.P. No.820 of 2016 in M.C. No.61 of 2015 on the file of learned IV Additional Junior Civil Judge, Rajahmundry.

2) Heard both sides.

3) The impugned order is set-aside and Crl.M.P. No.820 of 2016 is restored to file subject to payment of costs of Rs.5,000/ - (Rupees five thousand only) to respondents or their counsel on record before the lower Court. Both parties are directed to appear before the lower Court on 27.03.2017 and participate in enquiry. Any non-compliance, results in confirmation of the impugned order dated 19.10.2016.

4) Accordingly and in the result, the revision is allowed. As a sequel, miscellaneous petitions if any pending shall stand closed.
