THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7352 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/ A7 & A8 in Crime No.109 of 2022 on the file of L.M.D.Colony Police Station, Karimnagar District, registered for the offences punishable under Sections 143, 120, 120(B), read with 149 of Indian Penal Code and Section 4 of Explosive Substances Act, 1908, Sections 10, 13, 16, 18 of Unlawful Activities Prevention Amendment Act, 2008/2019. 2.
Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against these petitioners is that they were complicit in providing detonators and other explosive material to the alleged Maoists.

Learned Counsel for the petitioners submits that the petitioners are agriculturists and that there are no questionable criminal antecedents pending against these petitioners and they have nothing to do with any criminal activity of the Maoists. He
also submits that this Court granted bail to Accused No.6 in the present crime vide Crl.P.No5454 of 2022 dt.16.08.2022 and also to Accused No.10, 12, 13 and 14 in Crl.P.Nos.6814/2022, 4694/2022 and 4530/2022, respectively.

Learned Assistant Public Prosecutor on instructions would submit that the investigation is still pending and Accused Nos.1 to 4 have to be apprehended.

In the said circumstances, keeping in view the detention of the petitioners since 19.04.2022, this Court is inclined to grant bail to these petitioners/A7 & A8.

Accordingly, the Criminal Petition is allowed and the petitioners/A7 and A8 are granted bail subject to the following conditions:
i) The petitioners/A7 & A8 shall execute personal bonds for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for a like sum each to the satisfaction of Special Judicial Magistrate of First Class (Excise) at Karimnagar.
ii) The petitioners/A7 & A8, after release shall appear before the concerned Station House Officer, every Monday, Wednesday and Friday between 10.00 A.M. to 1.00 P.M.
for a period of six weeks and thereafter as and when directed, for the purpose of investigation.
iii) The petitioners/A7 & A8 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed.
