This writ petition is filed under Article 226 of the Constitution of India to declare the action of the respondent Nos.4 and 5 in interfering with the possession and enjoyment of the petitioners in respect of property admeasuring 3136 sq.

yards covered by H.Nos.1-14-246 to 1-14-356 in Sy.No.75/2 known as Kuntakatta Paina situated at Rasoolpura, Balamrai, Secunderabad cantonment and consequently direct the respondent Nos. 4 and 5 not to interfere with the same.

2. Heard learned counsel for the petitioners, learned Assistant Government Pleader for Home and perused the record.

3. Learned Assistant Government Pleader for Home produced written instructions stating that as many as 8 criminal cases are pending in respect of the said property. With regard to the above property, O.S.No.155 of 1997 and O.S.No.5 of 2014 are pending before the civil Court. After enquiry, the 5th respondent suggested the 7th respondent to approach the civil Court. An entry was made in the General Diary. Except registering the F.I.R., they did not interfere with the civil disputes between the petitioners and the respondent Nos. 7 to 9.

4. Recording the same, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
