ORAL ORDER:
Petitioners claim that 220 families belonging to SC/ST/BC and minority communities are in occupation of small extents of land and they have constructed houses and living therein in Ward No.16, Adarshnagar colony, Pidiguralle village and mandal, Guntur district for more than a decade. While so, they are sought to be evicted now without following due process of law, causing lot of hardship. Petitioners claim that they have submitted individual representations addressed to District Collector requesting to grant house site pattas but so far no orders are passed.

As per the instructions furnished, the learned Government Pleader disputes the claim made by petitioners on occupation of the subject land and states that the same was allotted to Mines and Industries Department for mining purposes 10 years back.

As the facts narrated in the affidavit are not clear and no details such as extent of land, etc, are furnished, no positive direction as sought for can be granted. However, since petitioners have already submitted representations, the District Collector/2nd respondent is directed to verify the prima facie claim of the petitioners of their alleged occupation and appropriate intimation be given to the petitioners as expeditiously as possible, preferably within a period of four weeks from the date of receipt of copy of this order. If the petitioners are in occupation of the subject land as they claim, till a decision is taken, status quo existing as on today shall be maintained.
