This writ petition is filed under Article 226 of the Constitution of India to declare the action of the respondents 1 to 4 more particularly respondent No.4 in unnecessarily calling the petitioner to Kalapathar Police Station in connection with Cr.No.164 of 2017, dated 11.12.2017 though the name of the petitioner is neither disclosed in the complaint without any whisper of allegations against him nor reflected in FIR as illegal and arbitrary and consequently direct the respondent No.4 and his officials not to arrest the petitioner and harass him.

2. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Home and perused the record.

3. Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint of 5th respondent, a case in Cr.No.164 of 2017 was registered against the son of the petitioner for the offences punishable under Sections 420 and 506 IPC on 11.12.2017 and investigation is going on. Application for grant of Anticipatory bail filed by the son of the petitioner was also rejected. As on date, the respondents did not summon the petitioner to the police station. As on today, no crime is registered against the petitioner. If any involvement of the petitioner is proved along with his son, they would follow due procedure before any action is taken.

4. Recording the same, the writ petition is disposed of directing the respondents not to interfere with the life and liberty of the petitioner except in accordance with law, unless his presence is required in respect of any other crime. _________________________ A.RAJASHEKER REDDY,J DATED: 09-07-2018 Hsd
