THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.4390 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.3 in issuing the Order in Proceedings No.

C/1576/2015 dated 13-05-2015 cancelling the Authorization of petitioner's Fair Price Shop No. 179 (New) F.P.S. No. 539 (Old) at Door No. 33-3, Rajeev Gandhi Nagar, I.D.A.

Jeedimetla, Quthbullapur Mandal, Medchal District, as illegal, arbitrary and in violation of principles of Natural Justice and set-aside the same, consequently direct the 3rd respondent to restore the Authorization of petitioner's fair price Shop No. 179 (New) F.P.S. No. 539 (Old) at Door No. 33-3, Rajeev Gandhi Nagar, I.D.A.

Jeedimetla, Quthbullapur Mandal, Medchal District, by supplying the essential commodities as it is to distribute the same to the ration card holders." 2.

Heard the learned counsel for the petitioner and learned Government Pleader for Civil Supplies for the respondents. 3.

As against the above said order passed by the Revenue Divisional Officer, cancelling authorization of the petitioner, petitioner herein filed an appeal before the Joint Collector

AVSS,J W.P.No.4390 of 2017 (CS) - 2nd respondent herein, on 20.08.2016 and also filed an application praying for stay.

Today when the matter is taken up, on instructions from the office of the Collector (CS), it is submitted by the learned Government Pleader that the appeal is posted for hearing on 20.02.2017 for final orders before the Joint Collector and the instructions of the Joint Collector, dated 09.02.2017, have been placed on record.

In view of the above, this writ petition is disposed of, directing the 2nd respondent - Joint collector to dispose of the appeal dated 20.08.2016 filed by the petitioner against the order of cancellation passed by the 3rd respondent, vide proceedings bearing No.C/1576/2015, dated 12.08.2015, within a period of four weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
