THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE MRS. JUSTICE ANIS CONTEMPT CASE No. 784 OF 2015 O R D E R: (per Hon'ble Sri Justice Nooty Ramamohana Rao) Even today, the Director General and Inspector General of Police, Government of Andhra Pradesh, Hyderabad has not chosen to appear in the Court. That only reflects his attitude towards the call of the duty. However, the Inspector General of Police, South Coastal Zone, Guntur Range is present in the Court today. Learned Government Pleader for Services (Andhra Pradesh) would submit that though this Court has passed the orders as long back as on 30.03.2014 and though the notice was issued in this very Contempt Case by this Court on 09.06.
2015, nearly three months after issuing such notice by this Court, the Inspector General of Police, South Coastal Zone, Guntur has passed orders on 03.09.2015 rejecting the claim of the petitioner for promotion as Inspector of Police (Civil). The learned Government Pleader would submit that the delay has occasioned in complying with the Court order because of the events leading up to and post-bifurcation of the composite State of Andhra Pradesh into two separate States.
Though the explanation offered for not promptly carrying out the orders of this Court is anything but acceptable, but nonetheless, in view of the fact that a speaking order has been passed on 03.09.2015, we leave the present proceedings at this stage, preserving liberty to the petitioner to pursue such remedies as are available to him under law to challenge the correctness of rejection of his candidature for promotion as Inspector of Police (Civil).
Accordingly, the Contempt Case is dismissed. The notice issued to the respondents stands discharged.
Consequently, the miscellaneous applications, if any shall also stand dismissed.
