This writ petition is filed under Article 226 of the Constitution of India to declare the action of the respondent Nos.3 and 4 in not taking action against the culprits pursuant to the complaint, dated 03.08.2017 followed by personal visits, as illegal and arbitrary and consequently direct the respondents 3 and 4 to act upon the complaint and take action in accordance with law.

2. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Home and perused the record.

3. Learned Assistant Government Pleader for Home produced written instructions stating that on receipt of complaint, dated 03.08.2017, 4th respondent made an entry in General Diary on the same day. A perusal of the complaint discloses that the matter is of civil in nature. The 4th respondent tried to inform the same to the petitioner, but he was not residing in the address mentioned in the complaint. The petitioner never turned up to the police station. The matter is civil in nature. Further, the 4th respondent has sent notice to the petitioner through Professional courier. The same is disputed by the learned counsel for the petitioner.

4. In view of the same, the respondents are directed to follow the guidelines laid down by the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh (2014) 2 SCC 1, if not already followed.
