Mainu, Nizamabad Dist. v. Prl. Secy., Home Dept. And 3 ORS.
THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON No.19417 OF 2013 ORDER:
There is no representation on behalf of the petitioner. In this writ petition, the petitioner is assailing the action of the respondent No.4 in interfering in the civil disputes and preventing the petitioner from entering and using his agricultural property admeasuring Ac.1.10 gts. in Sy.No.216, situated at Dongli Village, Madnoor Mandal, Nizamabad District.
The respondent No.4 filed a counter affidavit stating that on 04.12.2012 one Shaik Jareena (sister of the petitioner) approached the police of Madnoor Police Station, Nizamabad District and lodged a complaint. Pursuant to the said complaint, a case in Crime No.107 of 2012 under Sections 447 and 506 I.P.C. was registered and after completion of investigation, since a case has been made out, a charge sheet was filed. The Court below after taking cognizance of the offence, numbered the case as C.C.No.26 of 2013 against the petitioner and other accused. The said case is coming up for trial. In the light of the above, the contention of the petitioner that the respondent No.4 is interfering with civil disputes and preventing him from entering and using his agricultural property is not correct. As such there are no merits in the writ petition and the same is liable to be dismissed. Accordingly, the writ petition is dismissed. No costs. Pending miscellaneous petitions, if any, shall stand closed. ______________ P.KESHAVA RAO,J 06th NOVEMBER 2018.
