THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.29858 of 2013 ORDER:

The petitioner prays for Mandamus complaining against inadequate investigation into FIR No.233 of 2008 dated 17-04-2008 of Kushaiguda Police Station, Secunderabad, as illegal and unconstitutional.

The Assistant Government Pleader (Home) submits that permission was sought by the 4th respondent and the Assistant Commissioner of Police to file final report by referring the case as 'lack of evidence'.

Admittedly, the 4th respondent is unable to place record before this Court to show whether final report has been filed and while filing final report, whether petitioner has been put on notic e or not.

The Assistant Government Pleader submits that the 4th respondent will follow the procedure for filing final report and the petitioner can work out remedies available against final report. The statement is placed on record.

The 4th respondent is directed to file final report and serve notice on the petitioner within eight weeks from the date of receipt of a copy of this order. The petitioner is given liberty to

communicate copy of this order to 4th respondent by registered post with acknowledgment due for due compliance. The writ petition is disposed of accordingly. No order as to costs.
