HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.2857 OF 2013 ORDER:

In this petition filed under Section 482 Cr.P.C, petitioner seeks to quash the proceedings in C.C.No.25 of 2012 on the file of III Judicial First Class Magistrate, Miryalaguda, Nalgonda District, registered for the offences under Section 138 NI Act.

When the matter came up for hearing, learned Assistant Public Prosecutor produced the letter dated 17.07.2018 of Sub-Inspector of Police, Haliya Police Station, Nalgonda District and submitted that after filing of charge sheet, C.C.No.25 of 2012 (new C.C.No.265 of 2015) was registered and the same was ended in acquittal vide judgment dated 12.06.2017 and therefore, the petition which is filed to quash the proceedings in CC.No.25 of 2012 has become infructuous and hence the same may be dismissed. 3.

In view of the above submission of learned Public Prosecutor, the Criminal Petition is dismissed as Infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
