HONOURABLE SRI JUSTICE S.RAVI KUMAR TRANSFER C.M.P.No.721 OF 2013 ORDER:

This petition is filed to withdraw H.M.O.P.No.68 of 2013 from the file of Senior Civil Judge, Markapur, Prakasham District and transfer the same to the Family Court, Kadapa, Y.S.R. District. Wife filed this application contending that she is now staying at Kadapa at her parents house due to harassment caused to her and the respondent filed O.P.No.68 of 2013 before Senior Civil Judge, Markapur for divorce. She contended that she has no financial support and it is difficult for her to travel from Kadapah to Markapur which is nearly 200 K.M., She further contended that she is having small children and no male assistance to escort her from Kadapa to Markapur for defending O.P.No.68 of 2013. She further contended that respondent is working as lecturer and getting income and he can travel from Markapur to Kadapa.

She further contended that she also filed transfer C.M.P.No.145 of 2013 for transfer of C.C.No.362 of 2012 from Judicial First Class Magistrate, Giddaluru to Judicial First Class Magistrate, Kadapa and the same is pending. Respondent, in spite of service of notice, neither appeared in person nor through any advocate.

Heard advocate for petitioner.

He submitted that the petitioner is a lady without any financial support and it is difficult for her to travel from Kadapa to Markapur for defending O.P.No.68 of 2013 which is 200 K.M. away from her place of residence. He further submitted that by considering the convenience of wife, O.P.No.68 of 2013 may be transferred from Markapur to Kadapa.

I have perused the material papers including affidavit which remained unrebutted.

Considering the reasons stated in the affidavit filed in support of the petition and also convenience of the wife, H.M.O.P.No.68 of 2013 is withdrawn from Senior Civil Judge, Markapur, Prakasham District and transferred to the Family Court, Kadapa, Y.S.R. District for disposal in accordance with law.

Petition is ordered accordingly. No costs.

As a sequel to the disposal of this appeal, the Miscellaneous Petitions, if any, pending, shall stand dismissed. ____________________ JUSTICE S.RAVI KUMAR Dated 10-3-2015.
