Petitioner is challenging the Notice No.B/2528/2019, dated 25.10.2019 issued by the Tahsildar, Ghatkesar Mandal, proposing to conduct survey on 02.11.2019 on land in Sy.Nos.61,62, 63, 67 and 74 of Kondapur village. Petitioner alleges that said survey cannot be conducted in private lands and that there are several land owners, whereas only few land owners were issued notice to conduct survey. Learned counsel for petitioner submits that petitioner raised several objections on 13.11.2019 opposing conducting of survey.

Though several contentions are urged, it is seen from the prayer in the writ petition that petitioner is challenging the survey notice dated 25.10.2019 to conduct survey on 02.11.2019. According to learned counsel for petitioner, since some local residents raised objections, survey was not conducted. Since survey was not conducted on 02.11.2019, the notice itself does not survive. Therefore, there is no cause for the petitioner to challenge the notice in the Writ Petition. Leaving it open to petitioner to work out his remedy as and when notice is issued, Writ Petition is dismissed.
