THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18526 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the inaction of the respondent-Bank in pursuance to the letters dated 10.04.2017 and 13.05.2017 of the petitioner and taking physical possession of the stock lying in the premises of R-4 Firm, as illegal and arbitrary. Heard the learned counsel for the petitioner. Since this Court is not going into the merits of the case, there is no necessity to issue notice to the respondents.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the second respondent to pass orders on the representation made by the petitioner on 13.05.2017 seeking to take possession of the unsold stock lying in the shop and furnish the statement of account to the petitioner.

It is the grievance of the petitioner that even though he made a representation on 13.05.2017 to the respondent-Bank, till date no action has been taken and the respondents-bank authorities in collusion with unofficial respondents herein are trying to cause loss to the petitioner.

Having regard to the above, this Writ Petition is disposed of directing the 2nd respondent to consider the representation submitted by the petitioner on 13.05.2017 and pass appropriate orders thereon, in accordance with law, as early as possible,

preferably within a period of ten days from the date of receipt of a copy of this order. Learned counsel for the petitioner shall communicate a copy of this order to the respondent-bank for taking necessary steps.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
