HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioners challenge the notice, by which petitioners were directed to vacate and remove unauthorized and illegal construction of sheds alleged to have made by the petitioners on the land, which is falling within the full tank level area of Maddula Cheruvu Tank, without following due procedure and without giving due opportunity.

When the Court noticed such illegal procedure followed on the face of it, the Commissioner was directed to appear and explain.

Though learned standing counsel, on instructions, sought to justify the procedure adopted by the Commissioner, having regard to the fact that it is not supported by the statutory provision, informed the Court that said proceedings would be withdrawn and due process will be followed before taking coercive steps against the petitioners.

Having regard to the same and recording the said submission, the writ petition is disposed of as no further orders are required.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
