THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9205 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 and 2 seeking anticipatory bail in the event of their arrest in connection with Crime.No.225 of 2023 on the file of Mattampalli Police Station, Suryapet District, registered for the offences under Sections 420, 409 r/w 34 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the police is that these petitioners have withdrawn an amount of Rs.8,76,985/- in collusion with the Branch Manager. However, when it came to light regarding the said defalcation of the amount, Rs.1,00,000/- was paid in to the account.

Learned counsel for the petitioners would submit that thereafter D.D was taken and paid Rs.7,77,385/- in the name of Swatch Bharath Mission, Ramachandrapuram, however the said account was blocked.

Since the transactions are borne by record and the petitioners have undertaken to pay the entire amount within a period of one (01) week from the date of this order, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-.

1) The petitioners/Accused nos.1 and 2 are directed to surrender before the Station House Officer, Mattampalli Police Station. Upon such surrender, the said Station House Officer shall release the petitioners/Accused nos.1 and 2 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused nos.1 and 2 shall appear before the concerned police every day 10.00 a.m till one week and thereafter, as and when required for the purpose of investigation.

3) The petitioners/Accused nos.1 and 2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
