THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9206 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused seeking bail in connection with Crime No. 501 of 2023 dated 24.07.2023 on the file of Sanathnagar Police Station, Cyberabad District registered for the offences punishable under Sections 376 and 420 of Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioner/Accused and learned Additional Public Prosecutor for the respondent-State and perused the record.

The complaint was lodged on 24.07.2023 by the de facto complainant alleging that she was working as software developer in Hyderabad. She got acquainted with this petitioner in the month of March, 2022 and this petitioner expressed his love for her. In the month of March, 2023 the petitioner had sexual intercourse with

de facto complainant and convinced that he would marry her. But she did not complain to anyone. On 21.05.2023 after being counseled by the Sanathnagar police both of them married at temple. However, petitioner absconded. 4.

Learned counsel appearing for the petitioner would submit that marriage is admitted and as on date both are living together. The de facto complainant is carrying seven months pregnancy. The de facto complainant is present in the Court and admits that they were married and she is now pregnant.

Learned Additional Public Prosecutor also enquired with the de facto complainant.

Keeping in view with the above said circumstances, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-

1) The petitioner/Accused is directed to surrender before the Station House Officer, Sanathnagar Police Station, Cyberabad District on 29.09.2023. Upon such surrender, the said

Station House Officer shall release the petitioner/Accused on bail, on his executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused shall appear before the concerned police as and when required for the purpose of investigation.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 7.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
