THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 4904 of 2011 ORDER:

This Writ Petition was filed assailing the action of the Station House Officer, Guntakal Rural Police Station, Anantapur District, in calling the petitioner to the police station on a daily basis and threatening him. By order dated 01.03.2011, this Court directed the police authorities not to

interfere with the life and liberty of the petitioner if there was no complaint against him. However, this Court made it clear that in the event there was any complaint against the petitioner, the order would not preclude the police authorities from proceeding with the investigation in accordance with law. The learned Assistant Government Pleader for Home, basing on the written instructions dated 04.03.2011 received from the Station House Officer, Guntakal Rural Police Station, Anantapur District, informed this Court that the petitioner was arrayed as accused No.1 in Crime No.6 of 2011 on the file of the Guntakal Rural Police Station which was registered under Sections 324 and 354 I.P.C. The Station House Officer stated that it was in connection with the investigation into this crime that he had summoned the petitioner for questioning.

He further denied that the petitioner was forcibly taken to the police station or detained there. In the light of the aforestated facts, the Writ Petition is disposed of directing the police authorities to follow the due procedure laid down by law in the event investigation in Crime No.6 of 2011 on the file of the Guntakal Rural Police Station, Anantapur District, has not been completed and further steps are warranted against the petitioner in connection therewith.

Pending Miscellaneous Petitions shall stand closed in the light of this final order. No order as to costs.
