THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.275 of 2017 ORDER:
This Contempt Case is filed complaining non-compliance of order, dated 10.08.2016, passed by this Court in Writ Petition No.25950 of 2016.
Today, learned Government Pleader for Revenue (TS) appearing for the respondent filed a counter-affidavit along with a copy of proceedings, dated 28.03.2017.
A perusal of the proceedings, dated 28.03.2017, reveals that the application of the petitioner for mutation of his name as a successor of his father with respect to the subject property was considered and appropriate orders were passed. Though there is some delay in complying with the order of this Court, it was explained in the counter-affidavit that the Tahsildar, who was officiating at the relevant point of time, was involved in the ACB trap and in the process, the present incumbent Officer was not aware of the very application and the application was not traced. In those circumstances, the petitioner was called to submit a fresh application along with the relevant documents which were in fact submitted by the petitioner. Thereafter, the same was processed and the proceedings, dated 28.03.2017, were issued. In the
CKR, J C.C.No.275 of 2017 circumstances, there was some delay occurred in complying with the orders of this Court.
Having considered the counter-affidavit filed by the respondent and also the proceedings, dated 28.03.2017, this Court is satisfied with the explanation offered by the respondent in regard to the occurrence of delay in complying with the order, dated 10.08.2016, in Writ Petition No.25950 of 2016. Inasmuch as the order, dated 10.08.2016, passed by this Court in Writ Petition No.25950 of 2016 has been complied with, this Court deems it appropriate to close the Contempt Case. Accordingly, the Contempt Case is closed.
