ORAL ORDER:

This writ petition is filed, praying to grant the following relief. ....to issue an appropriate Writ Order or Direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondent Nos 2 to 4 in threatening to dispossess the petitioner herein from his lawful possession in respect of land in Survey No 21/21 admeasuring Acres 1.00 guntas situated at Dasnapur Village now in limits of Balaji Nagar Mavala Mandal Adilabad District without issuing any notice and following the procedure contemplated under the Law as being illegal arbitrary and unjust violative of Article 21 and 300A of the Constitution of India and consequently direct the respondent Nos 2 to 4 herein not to dispossess or in any manner interfere with the possession and enjoyment of the petitioner herein in respect of the above said land and to grant...

As petitioner contended that from private property owned by him, respondents are trying to dispossess him, this Court by order dated 20.11.2019 directed that petitioner shall not be dispossessed from the subject property without following due process of law and that petitioner shall not make any constructions in the subject land. The said order was extended from time to time.

The learned Government Pleader received instructions and placed before this Court photo copies of pahanies from 1955-56. All along, the subject land is shown as Government land i.e., 'Kharij Khata' and there are no entries of petitioner or his vendor. Petitioner, except placing reliance on sale deed of 1987, no other document is placed on record to show a semblance of ownership and possession. 4.

At this stage, learned counsel for petitioner seeks permission to withdraw the writ petition. Recording the same, the writ petition is dismissed as withdrawn. Miscellaneous petitions, if any pending, are closed.
