Heard Mr.G.Ramachandra Rao, for petitioners and learned Government Pleader for Land Acquisition for respondent Nos.2 and 3.

The petitioners challenge the legality of declaration under Section 6 of the Land Acquisition Act and invocation of power under Sections 17(1) and (2) of the said Act.

This Court has granted interim order on 20.12.2007. The respondents filed petition to vacate the said interim order. The necessity to consider the challenge to draft declaration or the justification of respondents need not be gone into. The respondents state that the proposals for acquisition of subject land are withdrawn and the subject land is not acquired for TRLIS Right Main Canal. The statement is placed on record. Writ petition is disposed of accordingly. The interim order already granted is directed to be continued and the petitioners shall not be dispossessed except in accordance with law. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. __________________ S V BHATT J
