HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.3 and 4 of 2019 In/and CRIMINAL PETITION No. 7493 of 2019 ORDER:
The petitioners, who are A2 and A3 in filed this Criminal Petition under Section 482 Cr.P.C. to quash the proceedings in Cr.No.162 of 2019 on the file of S.H.O. Gudipally Police Station, Nalgonda District, registered for the offence punishable under Section 109 IPC.
2. It is submitted that the 2nd respondent made a complaint against the present petitioners alleging that on the date of incident, they have encouraged his daughter to proceed on love with A1. However, later on, he came to know that when A1 and his daughter informed him through phone that they are committing suicide by consuming pesticide at Devarakonda, the petitioners went to that place and prevented them to do so and counseled them and also immediately informed the same to him through phone. It is further submitted that the present petitioners have gone to the place where A1 and his daughter were supposed to consume poison, with a good intention to save them and also informed this incident immediately to him. The 2nd respondent has given a complaint against them due to wrong impression that they have encouraged/instigated A1 and his daughter.
Therefore, the de facto complainant does not have any grievance against the present petitioners. It is further submitted that at the intervention of elders and well wishers, the matter has been amicably settled between the parties and in view of the amicable settlement, the 2nd respondent has decided to withdraw the case unconditionally against the present petitioners. Therefore, it is prayed to record the compromise and quash the proceedings. Accordingly, the de facto complainant filed I.A.Nos.3 and 4 of 2019 to record the compromise and to compound the offences. Along with the petitions, a joint memo came to be filed, which is supported by the affidavit of the second respondent.
3. Today, both the parties are present before this Court and submitted photographs and Aadhar cards, which show their identity. They are also identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the second respondent has no objection for quashing the proceedings against the petitioners.
4. In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.Nos.3 and 4 of 2019 are ordered.
5. Accordingly, the Criminal Petition is allowed in terms of compromise, and the proceedings in Cr.No.162 of 2019 on the file of S.H.O. Gudipally Police Station, Nalgonda District, against the present petitionersA2 and A3 for the offence under Section 109 IPC are hereby quashed. Miscellaneous petitions, if any pending shall stand closed.
