THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.4183 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/accused in C.C.No.1804 of 2015 on the file of Judicial Magistrate of First Class, at Miryalaguda, Nalgonda District, arising out of private complaint filed under Section 138 read with Section 142 of the Negotiable Instruments Act. Heard learned counsel for the petitioner and perused the material.

After arguing for sometime, the learned counsel for the petitioner/accused, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner/accused before the trial Court. In any event, considering the facts and circumstances of the case, the presence of the petitioner/accused before the trial Court is dispensed with except on the dates when their presence is specially required for the purpose of framing of charges, examination under Section 313 Cr.P.C. and on the date of judgment and the petitioner/ accused shall be properly represented by their counsel.

With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
