THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3196 of 2016 ORDER:
This Criminal Petition is filed by the petitioners-accused Nos.1 to 3 seeking to quash the proceedings against them in CC No.98 of 2014 on the file of the IV Additional Junior Civil Judge cum IX Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad. The petitioners are alleged to have committed the offences punishable under Sections 406, 409, 415, 420, 463, 468 and 477 r/w.34 IPC. The allegations against the petitioners are that they committed criminal breach of trust by filing statements in lieu of prospectus by fabricating the signatures of the 3rd respondent - de facto complainant for converting the 4th petitioner company from the private limited to the public limited and thereafter, they removed him from the Directorship of the 4th petitioner company. When the matter is taken up for hearing, it is submitted that the charges in the above CC are framed. Therefore, this Court is of the view that after framing of charges, the present petition is not maintainable.
Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, shall stand closed. _______________ RAJA ELANGO, J March 11, 2016.
