The Court made the following:

HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE HON'BLE SRI JUSTICE P. NAVEEN RAO COMMON ORDER: (Per the Hon'ble the Acting Chief Justice Dilip B.Bhosale) This writ appeal is directed against the interlocutory order dated 29.04.2016 passed in W.P.M.P.No.14307 of 2016 in W.P.No.11347 of 2016, whereby order impugned in the writ petition has been suspended.

2. Learned Advocate General for the State of Andhra Pradesh, on instructions, submits that the order impugned in the writ petition, namely, Memo dated 29.03.2016, whereby order of suspension of mining lease was passed, may be taken as withdrawn with liberty to the appellants to issue fresh order/proceedings and to take appropriate action, after following due process of law. Learned Advocate General submits that the appellants would give opportunity of being heard to respondent no.1 - writ petitioner before taking any adverse decision. The statement of learned Advocate General is accepted and recorded. In view thereof, Mr. D.Prakash Reddy, learned senior counsel for the writ petitioner submits that writ appeal and writ petition both may be disposed of as rendered infructuous. Accordingly, Writ appeal No. 425 of 2016 and Writ Petition No.

11347 of 2016 are disposed of as infructuous and as consequence thereof, the order impugned in the appeal renders ineffective. All contentions of the parties are kept open.
