Learned counsel appearing for the appellants reported that the appellants-claimants simultaneously filed claim petition before the Claims Tribunal, obtained award and as the present claim under the Workmen's Compensation Act, 1923 (for short 'the Act'), is not maintainable under Section 3 (5) of the Act, he is not pressing the appeal. Recording the said submission, the Appeal is dismissed as not pressed. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
