HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.25595 OF 2019 ORDER (ORAL) :

This writ petition is filed by the petitioner questioning the inaction of respondent No.4 - Station House Officer, Gachi Bowli Police Station, Cyberabad, Hyderabad, in registering a case on his complaint dated 01.11.2019 as being illegal and arbitrary and for a consequential direction to register a case based on his complaint.

2. Heard Sri Ram Prasad Teegala, learned counsel for the petitioner, and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4, and perused the material on record.

3. The learned Assistant Government Pleader for Home based on the written instructions dated 21.11.2019, a copy of which is placed on record, submits that upon receipt of the complaint from the petitioner, an entry was made in the General Diary on 01.11.2019 itself and as the contents of the complaint disclosed non-cognizable offences, addressed a letter to the learned XII Additional Metropolitan Magistrate, Kukatpally, to accord permission to register a case for the offences punishable under Sections 427 and 323 of Indian Penal Code, 1860 (for short 'IPC'), and after obtaining permission on 20.11.2019, a case was registered in Crime No.631 of 2019 for the offences punishable under Sections 427 and 323 of IPC on 21.11.2019.

4. In view of the aforesaid submission of the learned Assistant Government Pleader for Home made on behalf of respondent No.4, the grievance of the petitioner stands redressed, as such, no further orders are required to be passed in the matter.

5. Accordingly, recording the submission of the learned Assistant Government Pleader for Home, the writ petition is closed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition stand closed.
