THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.2804 of 2017 ORDER:

The present petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code'), is filed by the petitioner requesting to quash the First Information Report in Crime No.31 of 2017 of Mallial Police Station, Jagtial District.

The petitioner, who is the sole accused in the aforesaid Crime, alleged to have committed the offences punishable under Sections 323 IPC and Section 3 (1) (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015. Sri G.Madhusudhan Reddy, learned counsel for the petitioner, having tendered arguments, however, restricts the request to the extent of issuing a direction to the Investigating Officer to follow the procedure inlaid by the provisions of Section 41A of the Code. The request of the learned counsel for the petitioner appears to be reasonable and, invariably, the Investigating Officer has to follow the procedure provided under Section 41A of the Code. Acceding to the request of the leaned counsel for the petitioner, the Criminal Petition is disposed of with a direction to the Investigating Officer to follow the procedure under Section 41A of the Code and also

the guidelines laid down by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1.

Miscellaneous applications, if any, pending in the present petition stand closed.
