HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.17749 of 2015 ORDER:
The petitioners, who claim to be fishermen of Paleannaram (Narayanapuram) village, Chilukur Mandal, Nalgonda District, are not members of the Fishermen Cooperative Society, Paleannaram (second respondent - Society). They submitted an application on 09.02.2015 to the fifth respondent requesting him to delete the members belonging to other communities as per Article 75 of the Societie's byelaws. Thereupon, the fifth respondent made an endorsement on the said application directing the Additional Director Fisheries, Nalgonda to verify and take action. The said letter was forwarded to the third respondent and the third respondent, in turn, directed the Deputy Tahsildar to obtain a report from the VRO/MRO on 04.03.2015.
After receipt of the said letter, the Mandal Revenue Inspector, along with his staff, made enquiries and prepared a list of 239 actual members and sent to the third respondent in the month of March, 2015. The grievance of the petitioners is that, in spite of receipt of the said report, respondent Nos.3 to 6 are not publishing the list of actual members of the second respondent - Society. Hence the Writ Petition.
The grievance of the petitioners is with regard to their membership in the second respondent - Society. The second respondent is a Society registered under the Andhra Pradesh Cooperative Societies Act. It can manage its own affairs according to its bye-laws. The petitioners, who are not the members of the Society, cannot interfere with the affairs of the second respondent - Society. There is no statutory or any other basis for the relief
sought for by the petitioners.
In the circumstances, the Writ Petition is misconceived and is, accordingly, dismissed.
As a sequel thereto, miscellaneous applications, if any, also stand dismissed.
