THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7496 OF 2017 ORDER:

The writ petition is filed challenging the action of the third respondent in calling the petitioners to the police station without therebeing any crime registered against the petitioners and without following procedure contemplated under Section 41-A of Code of Criminal Procedure (CrPC). The learned Government Pleader for Home (Telangana), on the basis of the written instructions, submits that a case in crime No.35 of 2017 is registered against the petitioners for the offences under Sections 498-A and 506 IPC and Sections 4 and 6 of the Dowry Prohibition Act and that the case is at preliminary investigation stage.

In view of the above, no further orders are necessary in the present writ petition. However, it is needless to observe that the respondents shall follow due process of law, including Section 41-A of the CrPC, while investigating the crime.

The writ petition is accordingly closed. Consequently, miscellaneous petitions pending, if any, shall also stand closed. __________________________ A.RAMALINGESWARA RAO, J 13.03.2017 pln
